FedEx Sues U.S. Government to Recover Tariffs Following Supreme Court Ruling Against Trump’s Trade Powers

FedEx has filed a major lawsuit in the U.S. Court of International Trade, seeking a full refund of emergency tariffs imposed by President Donald Trump. This move comes as the first significant legal challenge following last Friday's landmark Supreme Court ruling, which found that Trump exceeded his authority by using the "International Emergency Economic Powers Act" to levy duties on imports.

Economists estimate that over $175 billion in collected tariff revenue could now be subject to refund claims. While FedEx’s lawsuit does not specify a dollar amount, it names the U.S. Customs and Border Protection (CBP) as a defendant. Legal experts anticipate a "floodgate" of similar lawsuits from other multinational corporations, though the recovery process remains complex as lower courts must still decide on the mechanics of the refunds.
